1. Terms and Definitions
The following terms and definitions are used herein:1.1. Internet-site (hereinafter referred to as the Website) means a collection of the web pages, located on the virtual server and comprising the united framework, used by Institute BelNIIS RUE to provide Users with information and to ensure access to the online interaction forms. The collection of the web pages, comprising the Website of Institute BelNIIS RUE, is located on the Internet at https://belniis.by.
1.2. Content means the Website content, represented in the text, graphic, audio and/or video format.
1.3. User means a legally capable physical person, having access to the Website, using the Website through the Internet to his own advantage or on behalf of the legal entity he represents.
1.4. Service means an access to the Website content, to the online interaction forms on the Website in order to locate applications, messages, requests, to subscribe to newsletters, to make contacts with Institute BelNIIS RUE representatives as well as to receive additional information, gratuitously provided by Institute BelNIIS RUE to the User after filling respective online interaction forms on the Website.
1.5. Online interaction forms mean types of services, located on the Website to facilitate standard interaction procedures between the Customer and Institute BelNIIS RUE as well as for initial application of User to Institute BelNIIS RUE. The forms are designed to locate applications, messages, requests, to subscribe to newsletters, to make contacts with representatives of Institute BelNIIS RUE.
2. General Conditions
2.1. This Customer Agreement (hereinafter referred to as the Agreement) shall refer to the Website of Institute BelNIIS RUE, located on the Internet at www.belniis.by, and regulate relations between Institute BelNIIS RUE and the User.
2.2. The Website is owned by Institute BelNIIS RUE and provided for use on the Internet free of charge.
2.3. This Agreement shall be a public offer in accordance with Article 407 of the Civil Code of the Republic of Belarus, addressed to the public and containing a proposal for each User to conclude an Agreement, regulating relations issues between the Company and the User, when using the Website under the terms, specified herein. Any actions of the User on using the Website, including first browsing of any Website page in the browser on any User’s device shall be considered the User’s complete and unconditional acceptance of the terms hereof according to Part 1 and Part of Article 407 of the Civil Code of the Republic of Belarus. In case of disagreement with the terms of this Agreement, the User shall immediately stop using the Website.
2.4. The User can accept the Agreement only by joining it as a whole.
2.5. The User shall hold personal liability for verification of the Agreement for any changes.
3. Subject of the Agreement
3.1. The Subject of the Agreement is to provide the User with access to the Website content and online interaction forms, presented on the Website.
3.2. The Website shall provide the User with the following types of service:
3.2.1. access to the Website content;
3.2.2. access to the search means and Website navigation;
3.2.3. access to the online interaction forms, allowing the User to:

make an application for works performance;

request information, ask a question through the feedback form;

leave a feedback about the satisfaction level of cooperation with Institute BelNIIS RUE by filling up a user satisfaction form;

leave an application for participation in the events, organized by Institute BelNIIS RUE;

subscribe to newsletters;

execute an electronic message.
3.2.4. access to the information about the provided services and special offers.
3.3. All the services of the Website, any of their further modifications and services to appear in future shall be subject to this Agreement.
3.4. Use of the Website content and services shall be regulated by the provisions of the applicable laws of the Republic of Belarus.
4. Website Use
4.1. A collection of the web pages and content, comprising the Website, cannot be copied, published, reproduced, transferred or distributed by any means, fully or in part, without proper references to the data source or without a prior written consent of Institute BelNIIS RUE.
4.2. The Website is protected by copyright and other rights, related to intellectual property protection, laws on the trademarks and unfair competition.
4.3. Online interaction forms do not require registration on the Website.
4.4. The User shall hold personal liability for all actions, performed during use of the Website.
4.5. The use of the Website shall be also regulated by the Regulation on personal data storage and processing terms, when using the Website of Institute BelNIIS RUE.
5. Rights and Obligations of the Parties
5.1. Institute BelNIIS RUE shall be entitled to:
5.1.1. changes the terms of the Website use. Changes shall come into effect once a new version of the Agreement is published on the Website;
5.1.2. change the Website content without notifying the User;
5.1.3. change the scope of the Website services and their content without notifying the User;
5.1.4. locate links to the external data sources, herewith Institute BelNIIS RUE shall not be liable for User’s visiting and using the external resources, links to which may be present on the Website.
5.1.5. restrict the access to the Website, fully or partially, without prior notice, in case of the Website termination or due to technical issues.
5.2. Institute BelNIIS RUE shall:
5.2.1. ensure access to the Website and its services free of charge;
5.2.2. keep the Website content updated.
5.3. The User shall be entitled to:
5.3.1. get access to the Website and its services at the respective address on the Internet;
5.3.2. use the Website solely for the purposes and in the order, specified by this Agreement and not prohibited by the laws of the Republic of Belarus.
5.4. The User shall:
5.4.1. not take any actions, which are or may result in violation of the laws of the Republic of Belarus or the international law standards, including those in the sphere of the intellectual property, copyright and/or related rights as well as other actions, which result or may result in violation of the normal operation of the Website and its services;
5.4.2. not distribute the Website content by any means without a proper reference to the data source or a prior written consent of Institute BelNIIS RUE;
5.4.3. not take any actions, which may result in violation of the confidentiality of the data, protected according to the laws of the Republic of Belarus;
5.4.4. not use the Website services in order to:
- upload content, which is illegal, violates any rights of the third parties; promotes violence, cruelty, hatred and/or discrimination; contains inauthentic data and (or) offense of certain persons, organizations, government bodies;
- induce to take illegal actions as well as assist persons, whose actions are aimed at violation of the laws of the Republic of Belarus;
- pretend being another person;
- act on behalf of the organization and/or society without sufficient rights for that.
5.5. The User shall be prohibited from:
5.5.1. performing unauthorized access to the Website functions, structure, services and content;
5.5.2. using any devices, programs, procedures, algorithms and methods, automated devices or analogue manual processes to introduce unauthorised changes into the Website’s content, services and/or structure;
5.5.3. disrupting the Website functioning, set by Institute BelNIIS RUE;
5.5.4. violating the Website security system;
5.5.5. using the Website for the purposes, forbidden by the laws of the Republic of Belarus.
6. Liabilities of the Parties
6.1. Institute BelNIIS RUE shall be liable for technical maintenance and protection of the Website.
6.2. Institute BelNIIS RUE shall not be liable for any losses, the User may suffer in case of intended or careless violation of any provision hereof.
6.3. The User shall hold full personal liability for accuracy of the data, provided when filling in the online interaction forms on the Website.
6.4. In accordance with the laws, public authorities of the Republic of Belarus, within their competence, shall be entitled to request from Institute BelNIIS RUE any data, collected about the User of this Website, and Institute BelNIIS RUE must provide it.
6.5. Institute BelNIIS RUE shall be responsible for:
6.5.1. delays or crashes during the Website use, occurred as a result of the force majeure circumstances as well as any other issues with telecommunication, computer, electric and other related systems;
6.5.2. improper Website functioning, in case the User does not have any necessary technical means for its use as well as shall not have obligations to provide the User with such means;
6.5.3. termination of the access to the Website in case the User violates any provision hereof or other document, containing the terms of the Website use.
7. Disputes Settlement
1.1. In case of any disagreement or disputes related to working or application of the provisions hereof, the Parties shall try to settle them by means of negotiations.
1.2. In case the negotiations fail, it is obligatory to submit a claim (a written proposal on voluntary settlement).
1.3. The claimee shall notify the claimant within 30 calendar days as of the receipt date about the results of the claim consideration.
1.4. In case the Parties fail to reach an agreement, the dispute shall be referred to the court in accordance with the applicable laws of the Republic of Belarus.
1.5. Any claim in relation to the terms of the Website use shall be filed within the term after the grounds for the claim arise, except for copyright protection for the Website materials, protected according to the laws. In case the terms of this clause are violated, any claim or grounds for it shall be extinguished by limitation.
